TERMS AND CONDITIONS

When purchasing the products offered under the brand TANGERINE via the website www.tangerine-studios.com, (hereinafter the “Website”) owned by INNOVACIO MATARO TEXTIL, S.L., (hereinafter “IMT”), the Client (hereinafter alternativeley, “User”, “You”/ “your”)  is consenting to be bound by the Terms and Conditions set herein. Moreover, IMT reserves the right to modify the content and/or scope of these Terms and Conditions at any time, without the need to communicate it or notify this to the Client in advance. Thus, before entering into a contract with IMT, please, read the content of these Terms and Conditions carefully.

If you do not agree to these Terms and Conditions, do not place an order on the Website. IMT assumes no obligation or liability for any order placed without such agreement.

Likewise, the Client declares being of 18 years old or older and legally capable of entering into binding contracts.

These Terms and Conditions regulate the distance contractual relationship between IMT and the User, in accordance with the applicable legal stipulations in force regarding distance selling, the General Law for the Protection of Consumers and Users (“Royal Decree Law No. 1/2007, of 16th November”), Data Protection Law (“Organic Law No. 3/2018, of 5th December”), and the Services of the Information Society and Electronic Commerce Law (“Law No. 34/2002, of 11th July”).

  1. Contract signing

When browsing the Website, the Client may create an account in the "User Area" section located at the top left of the Website. To create an account, the Client must provide their full name, email address and a password. This information will not be public. Upon registering, the User will receive a welcome email.

You are responsible for handling any information provided in the Website in a confidential and responsible way. You cannot assign your username and password to another user. You can modify your account details at any time by going to the "User Area" section of the Website. In the event a Client who has created an account has forgotten his/her password, he/she will be able to reset it by going to in "User Area" section and clicking "Forgot your password?".

In the "User Area" section, you can access and manage your order history, as well as remove records you no longer wish to view.

During checkout, the Client can either make a purchase as a registered user or as a guest, without having to create an account. In this case, the User will not have a Client Profile nor will he be able to access the Purchase History.

No contract in respect of any products shall exist between the Client and IMT until your order has been accepted by IMT. If IMT does not accept your offer and funds have already been deducted from your account, these will be fully refunded.

Once the order has been accepted, the User will receive an acknowledgment of receipt to the address indicated by email, telephone or any other equivalent means of electronic communication.

If the User has not received the confirmation within twenty-four (24) hours, he/she should contact IMT by sending an email to hello@tangerine-studios.com.

Likewise, IMT informs you that the contract may be drafted in the following languages: Spanish and English.

 

  1. Newsletters

Users may subscribe to the Website’s newsletter to receive the latest news and be the first to know about store discounts and promotions.

If the User has subscribed to the newsletter, but wishes to unsubscribe from it, he/she can do so using the link at the bottom any email of the newsletter or by sending an email to hello@tangerine-studios.com expressing the desire to unsubscribe to the newsletter.

 

  1. Data Protection

Pursuant to the provisions of the current regulations in relation to the Client's personal data provided during product purchasing process on this Website, the provisions of the Website's Privacy Policy[1] prevail.

 

  1. Product availability

IMT products’ availability may vary depending on market demand. IMT will prepare the products once the User has made the purchase, so the preparation will be exclusive for the Client. In case of non-execution due to unavailability or lack of stock, the amounts paid for the cancelled order will be credited no later than thirty 30 days.

If the chosen product is not available, IMT may supply a product with similar characteristics and with the same or higher quality, at no extra cost.

 

  1. Price

The price for each product will be expressed in Euros (EUR). Pursuant to the prevailing rules and regulations in force, all purchases done through the Website are subject to the Value Added Tax (VAT).

IMT reserves the right to modify its prices at any time and without prior notice. The price applicable to the purchase request made by the Client will be the one recorded at the time of placing an order.

 

  1. Payment method

The User can pay their order amount using any of the following chosen methods:

7.1 Credit card

All transactions involving the transfer of personal or banking data are done using a secure environment, a server based on the SSL (Secure Socked Layer) standard security technology. All information sent is encrypted through the network.

Likewise, the information regarding your credit card is directly entered on the bank's page, at the POS (Bank's Point of Sale Terminal) and is not entered or registered in any IMT server.

When paying with a credit card you will always be asked for the following information: Card Number, Expiration Date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your card, thus, providing more guarantees on the transaction’s security.

When the amount of a purchase has been fraudulently or improperly charged using the number of a payment card, its holder may demand the immediate cancellation of the charge. In this case, the corresponding debit and reimbursement entries in the supplier and holder accounts will be made at the earliest. However, if the purchase had actually been made by the cardholder and the return demand was not due to having exercised the withdrawal or resolution right and, therefore, had improperly demanded the cancellation of the corresponding charge, he will remain obliged to compensate IMT for damages caused as a result of such cancellation.

7.2 Paypal

 

Paypal enables signing payments on the Internet safely and comfortably. The PayPal network builds on the existing financial infrastructure of bank accounts and credit cards and creates a global real-time payment solution. PayPal offers a service specially designed for those who do not wish to use the traditional payment methods.

7.3 Apple Pay and Google Pay

  1. Shipping charges

8.1 Execution and delivery times

Garments purchased from the Website can be sent to Europe, the United States, Korea, Japan or Australia.

Once the Client has received confirmation of the order, the products will be sent to the address stated by the User, in the purchase process, within the term provided on the Website, and no later than thirty (30) days after signing the contract.

IMT shall not be liable for any errors that may occur in the delivery of the products purchased in the event that the Client has not correctly completed the delivery information form on the Website. If there were any incidents in the delivery time, IMT will inform the User adequately and immediately. The User must take into account that, in any case, no home deliveries will be done on Saturdays, Sundays and holidays.

In the event of failing to deliver the product due to the absence of the recipient, the transport agency will leave a notice and will try to contact the recipient by phone. After two (2) unsuccessful attempts, the User must contact the transport agency to proceed with the delivery.

The risks of the products will be borne by the Client from the moment they are delivered and, in the case of their return, they will continue to be borne by the Client until they are delivered to IMT.

The Client is responsible for return shipping costs. IMT is not responsible for any lost or stolen goods incurred during return shipping. Return deliveries with unpaid postage will not be accepted.

 

  1. Withdrawal

9.1 Withdrawal right:

You have the right to withdraw from this contract within a period of fourteen (14) calendar days from the date of the receipt of the item(s) without the need for justification.

To exercise the withdrawal right, you must notify IMT by means of an unequivocal statement (for instance, a letter sent by post or email). You can use the withdrawal form model attached.

To meet the withdrawal period, you need to send the communication indicating your wish to exercise this right before the relevant term expires. In any case, it is your responsibility to prove that you have requested or exercised this right.

9.2 Consequences of withdrawal:

If you want to exercise your withdrawal right, IMT will refund all payments received from you, except for shipping charges (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive one) without any undue delay and, in any case, no later than fourteen (14) calendar days from the date on which IMT was informed of your decision to withdraw from the contract. IMT will conduct any reimbursement through the same payment method used by the Client for the initial transaction unless the Client has expressly provided otherwise. In any case, the Client will not incur any expenses as a result of the refund.

IMT may withhold the reimbursement until the goods have been received, or until you have submitted proof of the return, depending on which condition is met first.

You must return or deliver the goods directly to IMT at the aforementioned address, without undue delay and, in any case, no later than fourteen (14) calendar days from the date on which you notify IMT of your decision to withdraw from the contract. The term will be considered as fulfilled if you return the goods before the term has expired.

 

  1. Guarantees

The legal guarantee of all our products is regulated by the Royal Decree Law No. 1/2007, of 16th November, regulating the Consolidated Text of the General Law for the Protection of Consumers and Users.

Likewise, the products must be returned in perfect condition with the labels and the corresponding packaging (boxes, bags, etc.) in the same way they were received, to the following address: C/Foneria, 15 Pol. Ind. Mata- Rocafonda 08304 Mataró (Barcelona), Spain and the return costs will be borne by IMT.

Once IMT receives the product, the company will verify that it does not meet optimal conditions for use and will proceed to repair, replace or refund the amounts paid for that product. IMT will reimburse the expenses paid by the Client to purchase the product.

 

  1. Complaints and claims

The Client may direct any complaints and claims to hello@tangerine-studios.com.

IMT must respond to the claims received in the shortest possible time and in any case within a maximum period of one (1) month since the claim was submitted.

In accordance with EU Regulation No. 524/2013, the European Commission has an online dispute resolution platform available to Consumers and Users, which is available at the following link: http://ec.europa.eu/consumers/odr/. Consumers can submit their claims using the online dispute resolution platform.

 

  1. Applicable law and jurisdiction

These Terms and Conditions shall be governed and interpreted in accordance with Spanish law.

Any disputes arising from, or relating to the contractual relationship between IMT and the Client must be resolved before the Spanish Courts[1]Insert link with the Website Privacy Policy.

EXCHANGES & RETURNS

Returns 

If your order comes from the United States of America, the United Kingdom or Switzerland, please contact us at hello@tangerine-studios.com for specific return instructions due to special custom procedures. If your order comes from elsewhere, please send your parcel back to the following address and we will proceed with the reimbursement once IMT receives the parcel: C/Foneria, 15 Mataró, 08304, Barcelona, Spain.

The customer is responsible for return shipping costs. We are not responsible for any lost or stolen goods incurred during return shipping. Return deliveries with unpaid postage will not be accepted.

If IMT mistakenly sent you an item that you did not order or the quality of any item is not adequate, contact us at hello@tangerine-studios.com. In this case, Tangerine will assume sending and return costs.


The conditions of exchange and return are:

  1. The article must be in its original condition with all the accessories. It must not have been used, washed, or tampered with.
  2.  It must contain the original labels.
  3. The customer pays the return postage. No returns will be accepted to pay ports.
  4. The refund amount will be returned to the same card with which payment has been made within seven days.
